This is WITHOUT A DOUBT fraud. You are entering the store and attesting to the fact you purchased them there in order to make a profit. There is not a single state where signing your name to false information to make a profit is not fraud.
Your chances for detection are minimal though and if caught they would likely just say "dont do that" The Walmart bit is fair game, though if you did it enough they would probably ban you from returns. Till then I say go for it. They set the price, heck, you may even been able to skip a step and just get a price adjustment. |

Action figure GOd says you're going to Action Figure Hell- endless searching and only MU series 1 Iron Man on every peg.

These stores have their heads WAY up their asses when it comes to MU. I say stick it to 'em!

Hey gents,
Here in Albuquerque, I figured out that we have one store among 7 which no longer sells MU figures. I had an inkling that this was true when I found a Bucky and a modern Havoc in their clearance section a few weeks ago, both for $4 or less. Anyway, I have a Walmart next door which has had torn and clearanced peg-warmers hanging up there for 6+ weeks. And when I took the torn package to the front to customer service, and found it back on the pegs UNCHANGED the next day, I decided to experiment. I bought all of the undamaged peg-warmers on a credit card and took them down to the clearanced store to see what would happen if I tried to return them there. I figured at worst they'd only return the figures at the in-store prices, and I'd just take them back to my local one with that knowledge in the future. Well, they accepted the return of 7 figures and gave me all of my money back. (Though I had to correct them when they used the wrong price on one by mistake). They had to change the price in their register from the in-store price ($2) to the receipt price, but they did so without batting an eye. I found it interesting, since they no longer had any space to put them up. The next day, I popped by just to see where those 7 would end up. There they were, right up on the Captain America 3.75" pegs in front of the remaining figures. There were no reduced prices on them, and no indication that they'd be any different than the peg price (full 7.99 or whatever). I grabbed a Union Jack and checked his in-store price at a scanner around the corner. It came up as $2. So I took it up to the register and paid $2.16 for a figure I didn't really care about that I had previously bought and returned for $7.99. So I don't know how this fits with all of your morals, but this has been verified to work. You do risk whatever figures you do this with being nabbed up until you get back there. Two of the 7 were gone by the time I got there, possibly not put back in the same place? And I left the rest of the figures I returned, since I didn't really want them anyway.

I knew this thread was ready to blow any second. Anyway, let me address the comments posed to me...

How do we know if it is loopholing until we know how much the store pays for their inventory?
Are you serious to think that anyone is jealous over some reject figures bought at discount after waiting in line 3 times between 2 stores? I thought the attitudes of most collectors would be that finding the cream of the crop at a decent price is the goal. I am not building a collection of dollar store toys. Savings should not be the goal because if you really need to save, then STOP collecting . 2. Reject, dollar store figures? We're talking Marvel Universe figures here. If you got lost looking for whatever gold-plated, diamond encrusted toys you collect, please feel free to continue your quest elsewhere and live us to building our dollar store collections. 3. I do need to save. So does about 98% of everyone else living on the planet. I still go to work, pay all my bills, taxes, and support myself with 100% effeciency with help from no one else. I feel that while doing so, if I want to go buy a case of toys, a pair of RYZ H-G3's, and 6 amaretto sours to get this chick to "open up", I will. I still like to save a dollar wherever I can. Even while doing so, I can also continue doing things I like. So, I don't need to STOP collecting just yet.

Really- this is just a step away from justifying the old Cantina Swap- after all "who cares about the store", right?
Untill they see a million MU returns nad decide no one wants the figures and stop carrying them. |

That's why the store you dump your returns at needs to be outside of your usual hunting grounds.

The "old Cantina Swap" is stealing. It states in pretty much every store's return policy that the contents must be returned with it's (own) packaging to conduct a return. One trying to return a Star Wars figure one put in Marvel Universe packaging is fraudulent. It plainly goes against the written policy and shouldn't be honored.

This is just as fradulent- it's costing the store money that they would not have otherwise have spent and it looks bad.
That you're doing it for several purchases makes it worse- the swap is bad (and funny) but it's just one item. |

Depends. What if the next person who buys them price matches the TRU ad and gets the second one for less. Either way I don't think "they may not have lost money on the deal" would be a defense an attorney would let you go with.
Target expects some of that though. Thats why they limit you to two or three returns without a receipt in a rollign yea, or why they told meas a cashier a couple years back not to bother with a price check if a customer disputed a price if it was less than $20. I'm not judging Do Boy, yeah it's technically illegal but so is downloading copy written material or playing the football card at work. If you're okay with it go with it. |

So does that mean taking a $7 toy to a Comic shop and getting $12 store credit illegal?

I don't think many Marvel Universe collectors are going to see a variant Archangel , or Unmasked Iron Patriot at the store and leave it there because they are waiting for a sale. Most of use share the same goal ; acquire cool toys at a decent price. acquire cool toys at a decent price first and foremost. Save on things if you have plenty of free time . Saving alone as a hobby means you waste a lot of time and might end up with less than you really wanted. I know so many people that drive all over to use a coupon . Dont get me wrong. I was very happy to buy variant Archangel for $4.98 and umasked Iron Patriot for $3.50 at Walmart. But I would have also paid $7.99 to get on with life and I do that often as well. Recently I debated on paying the full $25.00 at TRU for the Iron Man 2 Nick Fury 4 pack with 2 drones. They have sooo many that the clearance seems inevitable. Then I remembered my goal/ focus/ priority was to get one with good paint . So I went back and was able to pick the one I liked best of the 20 that were there (other stores have more) and paid full price. When I saw the new Assasins' Creed line at Target I kind of wanted it. Unfortunately it was never a priority so the current price forced me to " STOP collecting". I am waiting for the clearance on those toys because they are not really selling . I also had hoped by now we would have more insight as to whether or not PeterParkers clearance price is close to the store's costs. I often wondered how Target can sell me Tron , Terminator 4 , and Prince of Persia, DC Crisis,( I could go on) for only $1.48 on clearance. It seems like every short lived toy line gets marked down 75 percent at Target. If that is how much these stores buy them for then PeterParker's stunt left the store breaking even once all 7 get sold. This was a fun discussion. I love all of you guys. Sorry for the long post . |

Too many things to comment on!
And had I re-bought all of them, that's $6 for 7 figures, $42 bucks out of my own pocket I just saved. (Not that I did that). Quote:

You: "Here is 6 bucks Fedup"
Me: "Thanks!" You: "Hold on..there is a catch..you have to goto WalmartA and buy a figure..then drive 5 miles to WalmartB..get in the return line and return the figure..then go home. Two days later I need you to return to WalmartB and head to the toy isle and see if the figure has been returned to stock. Hopefully somebody didnt buy it before you get back there! Now goto the register to pay for it..it MAY have been marked at the discounted price!!! IT's that easy!! ME: Here's your 6 bucks back. Quote:

To me, in this battle between risk and reward, risk won. Too much hassle for me to bother attempting. Especially for pegwarmers that I probably already own...

If you are selling them to the comic store with the knowledge they were bought somewhere else as they think they can make a profit, no clearly not illegal. If you are lying to them saying you are returning a product you bought there but in fact purchased elsewhere, then yes, you are intentionally misleading them to gather a profit you are otherwise unentitled too. Again I'm not judging you for it. It's like sneaking into a movie. 50-50 chance that if you told the clerk what you were doing they wouldn't even care. The Walmart bit is legal. They were purchased legally. They were returned to another location per Walmart policy and purchased legally again. I mas actually do this during the coming weekend. |
