My Lobo was like that (but it was the right arm) and at least for me it wasn't broken it was just not fully assembled. It took a few tries and a hairdryer to soften the shoulder piece but I was able to pop the bicep peg in place and it's been fine since. Definitely would've been better if I hadn't needed to put it together myself but also could've been worse.

Todd himself just posted on his Facebook that the Year 2 Batman will go up for preorder on Friday 8am CST at Target. He did say that it'll be online only.

Word of caution to anyone interested in this figure: the upper arms have a tendency to break, right out of the package, even if you don't twist/turn the arm.
