I dunno, look at it from their point of view. They can't be expected to know every item in the store, let alone that the card art for this toy line usually accurately reflects the costume inside. There's a lot of toys that don't, including a few Marvel Universe figures. (The variant costumes in single carded figures, for instance)
Plus, regardless of what's in the package, it's still a toy that a kid might want and from the correct (sort of) figure line, and they can see what they're getting. So it's not like it will be thrown out and be listed as shrink. Which is why you'll see them go right back on the shelf even if you point it out to them. They can either take a loss on the item, or realize that it can still be sold to a kid that really wants that figure.
It's far easier to accept the swapped out figure back than for the customer to potentially make a scene, getting the manager involved, who might agree that it's easier to just take it back. It's easier to take a loss on a small amount than to deal with the hassle and a customer who might never come back. (You have no way of knowing how much this customer is spending on legitimate purchases)
But yeah, putting it on Ebay as a variant is just dumb.
