You can if the original design for the legs sucked. They were skinny, immobile sticks on skis and anything would be an improvement IMHO. The MTMTE version is much more dynamic and posable in toy form, and I prefer that to the G1 design.
Besides, I've seen Hasbro attempt to improve the skis-for-feet design before and they haven't been very successful (DOTM Whirl can barely stand unless you really tighten up his ball-joint ankles).

I'm not sure how you're transforming your Whirl, but I count two joints at the knee on each leg, and to me they do an excellent job of creating the raptor/chicken-leg stance.

Around two inches or so - which is standard size for a Mega Bloks minifig, really. It's the same basic design (structurally) that's been in most of their Halo sets to-date.
