Right now it's not that they would get in trouble. Just that no one has tested it. Most likely it would end up being the Nobody cares scene from Jurassic Park.
Mcfarlane clearly has gotten over even anti demon toy fear with this upcoming wave of Spawn figures.
The toy aisle itself has changed. Hasbro seems perfectly fine selling figures to online only retailers. There really is no excuse about any demonic ban anymore.
Well again things change but not as much as you think. And they probably wouldn't get in that much trouble over Megatrons that turn into a "Nerf Gun" or Cobra Commanders wearing hoods, either...but they're not going to "test" any of it. Plus Hasbro might be willing to do it, Disney could be the ones saying no here, the same way it's not McFarlane who decided everyone at DC has trigger fingers but just runs around using swords and crowbars.
McFarlane also is selling Spawn to the "collectors section" in the back of the store at Walmart and Target where the rules slightly differ, but not the toy aisle. But that toy aisle is still Hasbro's bread and butter and where the focus remains.
It's also likely why they don't just turn to the online "Fan Channels" for all of this because places like BBTS can't carry the same volume of product or bring in the same profit margin as Walmart to make it worth it to shift over for a bunch of probably new tooling heavy wave of the new "sexy and/or demonic" figures.
