I've seen scalpers create new listings for a pre-order item, obviously intending to get the pre-order themselves & immediately sell it at a higher price. But their fake listings will stay up longer than the original sellers so you have a "longer opportunity" to get it.
Pre-orders shouldn't even really sell out, IMO, since it's basically saying how much demand is for an item & not yet relates to what exists in reality.
No, there shouldn't. I'll explain this for the millionth time: The markup required to make a profit on something like that super duper ultra deluxe Spider-Man is too much. If you bought it for $50 plus tax and free shipping you'd need to sell it for $70-$75 just to make your money back. At this point you have a "seller" with the business acumen of Bud Light or a buyer who either has a mental disorder-sorry, I guess we call it FOMO now-or was too stupid to search (or wait) for a cheaper price. I'm not sure why I'm supposed to have pity for either of them.
And no, these companies don't care. I thought this was painfully obvious years ago.
Staff Edit: Please keep commentary general, not about specific members. Thanks.
Selling out on Amazon and Hasbro (especially the latter) is not proof of popularity, that's true. On paper this looks like a very good rendition of one of-if not the-the most popular comic book characters of all time so I think it's fair to say there are a lot of sales from folks who actually want this.
Whether or not something is expensive is a matter of opinion. If you think that Spidey is worth $50 then that's your decision, same if you don't think it's worth $50. Example: Your favorite toy is McFarlane's '89 Batmobile and the Batman that came with it. If you paid $50 for that pile of crap you shouldn't be lecturing others on what they spend money on. In my opinion, of course.

Despite being told repeatedly what a scalper actually is you still think it's someone who sells a figure for more than what they paid for it regardless at what point in time they sell it. That is unequivocally false.
Then you follow it up with "Hey if folks wanna pay methhead prices let em". If you think it's okay for people to pay whatever they want then who cares about scalping?
And lastly you bring up the fact that you prefer to spend your money on things "worth it" to you, like Street Fighter figures (an odd thing to bring up in a Marvel Legends thread) that you exaggerated the accessories and value of. What part of "worth is a matter of opinion" is not clear to you? Do you even like Street Fighter or do you just feel the need to spend money on toys for no reason?
Staff Edit: Please no direct personal attacks. Thanks.
