I agree that the black costume rocks. I like the design over the more traditional red/blue costume.

According to the bio on the back of the blister pack, this version of Venom is supposed to be Mac Gargan (Scorpion) merged with the Venom symbiote instead of Eddie Brock. I was under the impression that Eddie was the only host for Venom after Peter Parker rejected the symbiote but admittedly I haven't read Spider-Man in a long time.

That being said, I don't think the Venom figure is a fail. The tail is a separate accessory that doesn't necessarily have to be attached for display purposes. The detailing on this Venom looks pretty nice in the package, even on the included scorpion tail.
