To be considered a crime in the eyes of the Law, yes it is usually restricted to essential items (especially in the wake of natural disasters or similar emergencies). But the term can used to describe the same behavior regarding anything that is saleable, really.

I agree with others that the most important factor in deciding if a person is a reseller or a scalper is his or her intentions. Especially if they attempt to artificially alter the supply/demand ratio first (by buying up all the ones at retail) before asking for exorbitant amounts of money for their supply.

Of course, none of that matters when I see rants that sound like someone who's really just looking for an easy scapegoat or convenient bogeyman to help them vent their frustrations.
