While it's true that the deal states that Mattel does have first dibs to movie/show rights, if they DON'T have plans for certain versions, then other companies have a right to take a crack at it. Hence, why DCC is making Batman: the Animated Series.

So, if NECA doesn't have the rights to make a 1/12 scale Keaton Batman, there are odds that plans are in place for someone to produce some. I can, with almost great certainty, guarantee that you will see an all encompassing DC movie line by someone other than Mattel within the next 5 years. Probably not BvS, but older movies.

In fact, one need not look much further than the last DC Collectibles Q and A session...
