I got a response from Hasbro and this is what they said:
Jenn : Welcome to Hasbro CHAT, this is Jenn, how may I help you today?
James Huynh: Hi, I recent got a Rocket Racoon from the Marvel legends line, but the arm of Rocket broke. Is there anything Hasbro can do about it?
Jenn: Hi James! My apologies about this! I can help!

Jenn: Is it from Marvel Legends?
James Huynh: yes
James Huynh: marvel legends infinite series
Jenn: It shows that as being Nova.
James Huynh: oh sorry i think that is the wrong bog

Jenn: No, we will request the Racoon and if it is available we will send it to you. If not you may receive a different character.
Jenn: Regrettably, we cannot send back items.
James Huynh: so i won't get the broken figure back?
Jenn: No.
Jenn: Once the item is examined it is destroyed and cannot be retrieved.
James Huynh: Is there a way to check if it is still available, since I rather not get a different character since this one is hard to comby
