Sony & Marvel [Disney] have got a kinda shared contract, So Sony for the civil war film Have the rights to spider-man but they have to write for spider-man to fit into the MCU. think of it as a crossover for companies.
that's why we have a ton of spidey figures

Fox on the hand are keeping it to themselves [the rights] which may not last long for the FF franchise because they didn't make a marvel movie for a while or something, BUT i think that fox will be able to keep hold of x-men a bit longer due to "deadpool" movie being nearly a huge fan base like spider-man [dont take my word, all i know its big and will do well] I think will do well via box-office due to the leaked footage.

That's what i have heard online.
