Yes, MSRP is supposed to be $40, but Walmart stores are now charging $42 for items like megafigs and statues.

This is the Version 2 statue. Version 1 is the Walmart Exclusive Gold Label Red Highlights statue based on Jim Lee's poster for the movie. However, Walmart.com has not shipped online preorders. Instead, look for the huge four-sided display displays in stores.
In the plastic tray, there's a long plastic tie around Batman's torso. An information card and a base stand are held under a plastic shell glued to the cardboard tray. The cape fits through a slot in the tray so that the figure isn't pressed against it when inside the packaging. The statue is unable to stand on its own without the base (unless you put something under the right foot).
The packaging states that this is a 12-inch statue, but I'm assuming that includes the rooftop base. If you measure Batman's legs, torso, and head, he adds up to about 10.75- to 11-inches. This means that the statue is actually 1/7 scale, not 1/6 scale. I've posted pictures of him next to a 1/7-scale Joelle Jones Harley Quinn statue and a 1/6-scale Batgirl of Burnside statue.
This is a statue, but the right hand and right shoulder have some articulation. The right hand is not surprising since Walmart's Version 1 statue has a different hand (no batarang). Versions 1 and 2 are probably cast from the same mold, just given different paint apps and right hands. I was a bit surprised that the right shoulder moves; when it did, I thought I had broken it, lol.
The eyes are painted glossy black, which makes the mask look rather creepy. There are lots of details, such as the pouches on the belt. There's even a holstered grapnel strapped to the right thigh, which is a huge improvement over the goofy design given to the 7-inch
masked action figure
. The cape is made of a soft rubber, which makes it less easy to tear/break over the long run. The head seems proportional to the body, unlike the head on the 7-inch action figure.
$40 is a great price point for a statue this big. Diamond Select Toys uses an MSRP of $50 for its PVC Gallery statue line, and many of them are 1/8 scale.
Areas of concern:
-- None really, but try to pay $40 instead of $42 if you can, lol.
