So I was searching ebay for Winter soildier captain america comic pack and noticed that an ebay seller MARVEL UNIVERSE CAPTAIN AMERICA TARGET EXCLUSIVE COMIC PACK BUCKY WINTER SOLDIER | eBay has used one of my images and replaced a watermark on it claiming it as his in his auction, quoting "Condition
100% COMPLETE & MINT! Was recently removed from the box and NEVER played with and NEVER displayed. Item comes with everything seen in the picture and is from a smoke & pet FREE home." Am I overeating in being pissed because I took the work to photo this figure and some one just straight cropped it and watermarked it as theirs or am I making a big deal of it? I mean wouldnt someone look at this picture and what if the paint apps on the one someone ordered from this guy are all messed up but used my pic to scam someone into thinking it was the figure pictured. I want to email this guy and tell him/her to stop using my images or at least leave the watermark but its the internet, you cant stop everyone. Whats your guys' take comment bellow. Yea that is kind of low claiming to be the one ON HAND. If he just used your picture and kept your website on the picture then it is like "free advertisement". Message the guy and just tell him that obviously isn't the exact one on hand because you OWN that exact figure because it is YOUR WEBSITE. What's to lose? Going to anger some eBay seller? Do what you got to do man!

You could cite it as false advertising and report him? Yes it is a WS toy he's selling, but the picture isn't of the actual toy he's selling. For all his claims of it being mint, it could be all banged up and he could just claim it was damaged in transit to whoever buys it.
But I get where you're coming from... If it was any of my work being used without my permission I would be annoyed as well.

Its not like i care if people use the images, hell thats what they are for, but come on at least leave the watermark. I left it off to the side so as to not obstruct the figure itself I dont want to be like alot of sites that have huge watermarks all over the place all i ask is that it remains in full you know? Either way I did report it and sent him/her an email about it shortly after posting I couldt wait for a response from you guys lol, lets see what happens. Thanks for your comments guys I knew I wasnt crazy lol.

I think you should be flattered he used one of your photos to try and sell one of his figures.
He may not be a very good photographer and it shows your work is good enough to stand out as one that might help sell a figure. Don't be upset, be flattered.

i can see the point you have with being upset, personally, for me if i saw my pic on someones sale thread i wouldnt care, if anything ide be flattered that someone wanted to use my pic, but then again i don't take pics as clear as yours. the listing states it comes with everything seen in the picture, not that he took the picture of the actual toy (unless i overlooked it) i see people selling hot toys all the time and referenceing official pics instead of the pics of the actual toy in hand. i do see your point but i would feel more flattered.....

I agree and understand your argument here. Its good that the seller fixed it. Ebay is always a cautious buy where we don't know what we are actually getting. Sometimes the picture presentation is a great selling point and he probably took your photo because he felt it was a great pic. Still shady and the fact he removed the water mark shows the shadyness. I hope its not an arker here.

For future reference, use of other's images is not permitted per eBay policy: Images and text policy
When it happens, report the seller via eBay's "Report Item" link (on the far right) on every item auction page. |
