Seeing way too many Hasbro Legends figures over Toy Biz ones...and there's no way they should dominate any top ten. To be a little more unbiased...I will break my list down to five of each, plus one BAF from each run in no particular order...

Toy Biz Era

1. Face Off Captain America

3. Series 8 Doctor Octopus
4. Series 4 Punisher
5. Onslaught Series Green Goblin

BAF: Sentinel

Hasbro Era

1. Pizza Spider-Man (Hobgoblin Series)

BAF: Rhino

I didn't include certain popular figures because they were not an official part of the Marvel Legends lines, and were figures from some of the many off shoot lines that were released, such as Spider-Man and X-Men Classics, or the Iron Man movie series figures....but here are 5 of my favorites from those lines as well...

I agree Toy Biz Legends are better than Hasbro's but some of Hasbro's are great too.
In no order and also limiting my Captain America's and Spidey's to 1 entry each.

I think a big part of the Hasbro domination in lists is a lot of us are newer collectors and thus have more Hasbro than Toy Biz figures. Are the rest of you making lists based off of sculpt/quality of the figure, favorite characters, want for a collection or some combination? Mine is definitely a combination as some of my favorite figures are of characters I do not really care about and some favorite characters did not make the list. I am also basing my list only off of figures in my collection.

In no particular order. I will inevitably forget one that I meant to put on this list anyway.

Nova (GotG wave)
Pizza Spidey (Hobgoblin wave)
Star Lord (Thanos Imperative box set)
Punisher (Series 4) - never thought I would like it until I got one in hand but he's awesome
Taskmaster (Legendary Riders series)
Colossus (Series 5)
Thor (Terrax series) - case in point on the like the figure but do not really care about the character
Spider-Man 2099 (Hobgoblin series)
Gamora (GotG EE Box Set)
Wolverine (Puck series) - yes me, Mr. Hate Wolverine, put him on my top 10 list because I think the figure was done superbly

Favorite BAF: Tie between Rocket Raccoon (my most sought after) and Rhino (never intended to even build him and now he's one of my favorites)

Honorable Mentions:
Ant-Man (Ultron series) - would have made the list if the mask was movie accurate
Silver Surfer (Series 5) - AWESOME figure but the head sculpt bugs me
Thor (Allfather series) - it was a toss up between this one and the Terrax series one
Scarlet Spider (Rhino series) - just missed the cut
Captain Marvel (Allfather series) - also just missed the cut

Since I'm mostly a DC guy, then I'm buying a Marvel character figure, it has to be (what I judge) a perfect rendition of a character I like. Toy Biz ML was not really my cup of tea as I value more sculpt/overall look over articulation/posability. That's why I was totally into DC Direct when everyone was collecting Toy Biz ML.

There's a LOT of really great ML figures out there. While the females from Toy Biz were mostly lacking, they had some really great male and larger figures. But I think my top 10 in no particular order are:

Blastaar
Scarlet Witch (Hasbro)
Juggernaut (while not in order, I think I have to say this is my very favorite ML figure. He's certainly the one I paid the most for...)
Omega Red
Hela
Blackheart
Spiral
Abomination
Storm (Hasbro)
Bishop

It's not necessarily my favorite characters just that these are really well made figures. I also just realized that's 5 TB and 5 Hasbro...not intentional.

Archangel gets an honorable mention. Also adding the TB Black Panther and Phoenix also were way up there for me.

As far as BAF, I'm going to list my top 3 I think. TB beats the pants off Hasbro in the BAF department.

Sentinel. Absolutely hands down my favorite BAF. This is the thing that got me into collecting ML (I only had the ML Thor up to that point)

Apocalypse
Hulkbuster (one of the few really great Hasbro BAF)

I've seemed to flip flop. In the 90s as a kid I was a Marvel kid with the exception of Batman, Flash, and Superman. Around 99 I completely became a DC kid with the exception of Spider-Man until Brand New Day came out. Now I think both companies suck and only have a small amount of great stories being written. I was hoping Convergence was going to allow DC to get some good writers again while Secret Wars was going to do the same to Marvel, but Marvel can't even keep a release schedule for Secret Wars while Convergence changed nothing.

ToyBiz and Hasbro approach MLs from two completely opposing avenues, so it's incredibly hard to compare the two. I'll try and keep it even, though, because it's only fair to the originals.
In order of favour:

1) Marvel Now Storm (Jubilee wave)
2) Beast (Series 4)
3) Scarlet Witch (Allfather wave)
4) Nightcrawler (Series 9)
5) Rachel Grey (Phoenix variant) (Queen Brood wave)
6) Psylocke (SDCC 2012 Uncanny X-Force exclusive)
7) Winter Soldier (Hasbro two pack)
8) Ghost (SDCC 2013 Thunderbolts exclusive)
9) Black Panther (Rocket Raccoon wave)
10) Phoenix (Series 6)

Favourite BAFS: Sentinel, Hobgoblin.

Worthy mentionables: Onslaught wave Green Goblin and Loki, Series 8 Black Widow (I love her Frank Miller-inspired design), Allfather wave Captain Marvel, and Series 14 (?) Falcon (modern variant).

I love Phoenix, I think she's fantastic. The face, the hair, the sash, the paint. All she needs is subtler shoulder joints and the new female Scarlet Witch/Wasp hands, and she'd be perfect!

First Appearance Daredevil was almost on my list, too. He's a top notch figure!

3.ToyBiz Series 4 Punisher (the look of this figure is just perfect)
4.Onslaught Wave Green Goblin

6.Hobgoblin Wave Daredevil (like with Punisher, the look is perfect)
7. Galactus Wave Black Panther
8. Green Goblin Wave Black Cat (this figure is the one that brought me back to the Marvel Legends game)
9. Rhino Wave Ghost Rider (once again...perfect)
10. BAF Rhino

Honorable Mentions: Rhino Wave Kraven, Allfather Wave Scarlet Witch, SDCC Dormammu, EE GotG set (yes, the whole damn set), Amazon Exclusive Thor, Absorbing Man Wave Venom and Morbius

The list might just move around a bit once I get Series 8 Doc Ock because that figure looks fantastic, but I'd say it's good for now.

Honestly there's a lot more figures I can put on there but I had to draw the line somewhere lol.
