Yea, I just checked the neca twitter page and it says expect some new ones at nycc next month. Randy also said further down that if you like the first w waves wait for series 3 and 4. Plus that page is loaded with fans posting pics of these. Bbts also seems to be sold out of some of the singles already. That tells me they are selling. I think you have some bad info there.

I get email notices from a store called House of Mysterious Secrets. I just got a notice from them that they are cancelling and refunding orders for the NES Freddy and Jason. They said that they hope to offer them again in the future.

Not sure if they are having trouble getting them because they are a smaller store or if Neca delayed/cancelled them. Could be a last minute lawsuit monkey wrench.

From my understanding, the lawsuit is solely over copyright ownership of the original movie. So the name Friday the 13th, camp crystal lake, Pamela Voorhees, young Jason, etc. Adult Jason, the hockey mask, and the machete weren’t created/used until the sequels, so there really isn’t any ownership dispute over that (from what I can tell).

It really doesn’t seem like the suit should have any effect over merchandising for the sequels, expect they couldn’t use the generic Friday the 13h name, they would specifically need to say something like “Friday the 13th Part III” or whatever movie they’re licensing from (like why you see Hellraiser 3 and Halloween resurrection merch rather than the originals)
